Last week, we heard an ad on Bloomberg Radio that advertised an offer that sounded too good to be true:

Low money down real-estate investing with rent guaranteed for 5 years, positive monthly cash flow, and more!

Like many sure-fire investment opportunities advertised over the airwaves, it needed further due diligence.

So we called the advertised number to find out more.According to Google, the number rang a phone in Hoboken, New Jersey. A man with a gruff voice picked up. After asking for our name, he launched into a three-minute, uninterrupted speech. All attempts to ask questions were deflected. “Just give me three minutes then I’ll answer any questions you have.”Here’s how the man on the phone said the deal works:

A company called National Realty manages foreclosure investments in Center City Philadelphia , where it acquires land at “deep discount.” It then builds townhouses on that land at a cost of $350,000 apiece. The townhouses are 100% financed through National Realty. Once the townhouses are built, their value “immediately becomes $450,000”–meaning that, in theory, you’re pocketing $100,000 of profit right away. They say they’ve done 300 houses in the last three years.Once your townhouse is built, you get tenants for the home – “guaranteed.” And the cash flow from rent is “guaranteed” for at least five years. This, the man says, is due to the company’s great relationship with Philadelphia’s most prominent property managers. Sounds great, right?

NRIA’s ads often appear on Fox News. Not disclosed to viewers: The FBI and the U.S. Securities and Exchange Commission, with regulators from three states, are investigating the firm.

National Realty Investment Advisors is known in Philadelphia for the thousand-plus rowhomes it has built for investors to rent out and as the owner of one of the citys biggest development sites, the swath of Delaware River waterfront land where part of a sprawling casino complex was once envisioned.

Outside the city, the Secaucus, N.J.-based firm might be better recognized from its advertising blitz on Fox News Tucker Carlson show and elsewhere that has helped it raise more than half a billion dollars by promising investors market-beating returns from projects up and down the East Coast.

But there is much that NRIA hasnt highlighted in its messaging.

Federal prosecutors have charged a key executive, Thomas Nicholas Salzano, 63, with fraud, saying he used phony loan papers to try to reel in an investor. Salzano helped lead NRIA after he settled with federal regulators in a previous financial fraud.

The FBI and the Securities and Exchange Commission, as well as financial regulators from three states, are investigating the firm. NRIA itself cited those probes in a recent prospectus for potential investors. No criminal charges or civil complaints have been made against the company.

NRIA said it has sold more than $136 million in real estate this year, with more sales in the pipeline.

Portfolio Manager Of Real Estate Investment Fund Charged With Using Sham Loan Document To Obtain Money From Investor

NEWARK, N.J. A portfolio manager and senior independent executive advisor at a Secaucus-based real estate fund was charged with using a sham loan document to defraud an investor of hundreds of thousands of dollars, Acting U.S. Attorney Rachael A. Honig announced today.

Thomas Nicholas Salzano, aka Nick Salzano, of Secaucus, New Jersey, was charged by complaint with one count of wire fraud and one count of aggravated identity theft. Salzano appeared by videoconference on March 4, 2021, before U.S. Magistrate Judge Leda Dunn Wettre and was released on a $100,000 unsecured bond.

According to documents filed in this case and statements made in court:

Near the end of 2018, Individual 1 approached Victim 1 about a supposed new opportunity to become a joint venture partner with NRIA in a property in North Bergen, New Jersey, allegedly owned by NRIA. According to Individual 1, the minimum investment was $300,000, and Victim 1 could use her original $150,000 investment in the NRIA fund toward the required $300,000 investment in the North Bergen property.

Victim 1 asked Individual 1 for more information on the North Bergen property. Individual 1 sent Victim 1 materials purporting to show that NRIA intended to obtain a $25 million bank loan on the property. Victim 1 asked for information on the loan. Individual 1 then referred Victim 1 to Salzano.

With Sec Probe Underway Whistleblower Alleges Fraud At Secaucus

With a U.S. Securities and Exchange Commission probe underway, a whistleblower is alleging that fraud is taking place at Secaucus-based real estate fund National Reality Investment Advisors , which boasts over $1 billion in assets under management.

The record shows, FOIA request prove, that in August 2020 I filed a report with the SEC on a whistleblower statute and filed a report. I was communicating with the chair of the SEC before that, Barry Minkow, 55, exclusively told HCV in a phone interview.

His filed with the SEC said the NRIAs conduct is a fraudulent investment, in particular a Ponzi/pyramid scheme.

NRIA is offering returns that appear to be unparalleled in the industry. Their cost of capital is, for lack of a better term, astronomical. They advertise on a national scale every day for new investors AND they are offering returns ranging from 10% per year paid monthly, he wrote, noting that other commercials made the same claims with 16 and 21 percent.

Minkow later points out that he is not your typical fraud investigator.

I worked with the SEC uncovering frauds mostly from your Los Angeles office with Peter Del Greco. We did numerous cases together. However, I returned to prison for insider trading in 2011 and was released in 2018, the report says.

While he was sentenced to 25 years in prison on charges including racketeering, securities fraud, money laundering, embezzlement, and bank fraud, he ended up serving under seven-and-a-half years.

The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.

On 06/07/2021 the Securities and Exchange Commission charged Thomas Nicholas Salzano, of Secaucus, New Jersey, with using a sham loan document containing a forged signature in a fraudulent attempt to entice a $150,000 investment in a real estate joint venture located in New Jersey.

The SEC’s complaint, filed in federal court for the District of New Jersey, charges Salzano with violations of the antifraud provisions of Sections 17 and of the Securities Act of 1933, and seeks injunctive relief, civil penalties, and an officer and director bar.

In response to these allegations, the business provided the following statement:

“NRIA understands that there is a government investigation underway, arising from an isolated event that took place in 2019. It involves a communication between an independent contractor and a single investor. The isolated event was resolved two years ago, with no loss of investor capitalas has been the case with every NRIA investor since our inception in 2006.
